  29. How to Contact Us

These terms and conditions of use (“Terms of Use”) govern your use of our online interfaces and properties (e.g., websites and mobile applications) owned and controlled by Save My Knee, LLC, doing business as Root & Iron Rehab & Performance (“Root & Iron,” “we,” “us,” and “our”), including rootandironperformance.com and any Root & Iron mobile application(s) (the “App”) (our websites and mobile applications are referred to herein collectively as the “Site”), as well as the online movement, rehabilitation, fitness, performance, educational, and related services (“Services”) available to users through the Site.

The terms “you” and “your” mean you, your dependents, if any, and any other person accessing your Root & Iron Account.

Your acceptance of, and compliance with, these Terms of Use is a condition of your use of the Site and Services. By clicking “accept,” creating an account, purchasing Services, or otherwise using the Site or Services, you acknowledge that you have read, understand, and accept all terms and conditions contained within these Terms of Use and our Privacy Policy. If you do not agree to be bound by these terms, you are not authorized to access or use the Site or Services and should promptly exit the Site.

Binding Arbitration. These Terms of Use provide that disputes between you and Root & Iron that relate to these Terms of Use or your use of the Site may be resolved by BINDING ARBITRATION. ACCORDINGLY, TO THE EXTENT PERMITTED BY LAW, YOU AGREE TO GIVE UP YOUR RIGHT TO GO TO COURT, INCLUDING PARTICIPATING IN A CLASS ACTION PROCEEDING, to assert or defend your rights under these Terms of Use. Your rights will instead be determined by a neutral arbitrator and not a judge or jury, subject to applicable law. Please review Section 19, entitled “Dispute Resolution; Arbitration Agreement,” for additional information.

1.Privacy Practices

You agree that information provided by you in connection with the Services and Site shall be governed by the Root & Iron Privacy Policy, which is hereby incorporated into and made a part of these Terms of Use.

2.Services Provided – Medical Care and General Information

The content of the Site, including, without limitation, text, copy, audio, video, photographs, illustrations, graphics, electronic communications as defined in Section 6, and other materials may include educational and general informational content concerning rehabilitation, movement, exercise, fitness, injury prevention, performance, and wellness.

General content made available publicly through the Site does not, by itself, constitute individualized professional medical advice, diagnosis, treatment, or recommendations and is not intended to replace consultation with a qualified healthcare professional.

You should always seek the advice of an appropriately qualified healthcare professional regarding questions or concerns about your individual needs, symptoms, injuries, health conditions, or treatment.

Unless you have separately entered into a professional provider-patient relationship with a licensed healthcare provider affiliated with Root & Iron and are receiving individualized physical therapy or other healthcare services from that provider, use of the Site, viewing educational content, submitting general inquiries, or interacting with general informational resources does not create a provider-patient relationship.

Your interactions with general Site content are not intended to replace your relationship with your regular healthcare practitioners or primary care physician.

Root & Iron, its subsidiaries, affiliates, and third parties that may promote or provide links to the Site or Services shall not be responsible for decisions made solely based on general information obtained from the Site.

Root & Iron does not endorse or recommend any specific medication, physician, medical test, surgical procedure, or third-party product solely by virtue of its appearance on the Site.

You acknowledge that reliance on general information received through the Site or Services is at your own risk.

Not for Emergencies

If you are experiencing a medical emergency, call 911 immediately.

The Site and online Services are not intended for medical emergencies or urgent situations. You should not disregard or delay seeking medical attention based on anything that appears or does not appear on the Site.

If you believe you are experiencing a medical emergency, call 911 or seek immediate emergency medical care.

You should seek emergency help or appropriate follow-up care when recommended by a physician or qualified healthcare provider or whenever otherwise necessary. Continue to consult your primary care provider and other healthcare professionals as appropriate.

Always seek the advice of a physician or other qualified healthcare provider concerning questions regarding a medical condition and before stopping, starting, or modifying medical treatment.

3.Availability of Services

You represent that you are not prohibited from enrolling in or receiving the Services under the laws of the United States or any other applicable jurisdiction in which you may be located.

Accessing the Site or Services from jurisdictions where the content or Services are unlawful or where Root & Iron does not offer Services is prohibited.

Certain healthcare, physical therapy, telehealth, or rehabilitation Services may only be available in jurisdictions where the applicable provider is appropriately licensed or otherwise legally authorized to provide such Services.

4.Ordering and Purchasing of Services

Typographical Errors and Incorrect Pricing

If a Service is listed at an incorrect price because of a typographical error, technical error, or incorrect pricing information received from a third party, we reserve the right to refuse or cancel orders placed for the Service at the incorrect price.

We may refuse or cancel such orders whether or not the order has been confirmed or your credit or debit card has been charged.

If your payment method has already been charged for a purchase that is subsequently canceled by us because of a pricing error, we will issue an appropriate refund or credit for the canceled purchase.

Online Payments

You may be able to purchase Services through the Site.

We may accept credit cards, debit cards, and other payment methods made available through our payment processor.

You authorize Root & Iron and its payment processors to charge the payment method you provide for Services, fees, subscriptions, memberships, programs, or other amounts for which you are responsible.

If a credit card is used for a transaction, Root & Iron or its payment processor may obtain authorization or preapproval for an amount up to the amount of the anticipated payment.

You authorize Root & Iron and its payment processors to securely store your payment information when applicable.

You understand and acknowledge that Services may be suspended, canceled, or withheld if an authorized payment cannot be processed, subject to applicable law. Revoking authorization does not eliminate responsibility for charges already incurred or otherwise lawfully owed to Root & Iron.

You represent and warrant that:

  • (a) any credit card, debit card, bank account, or other payment information you provide is true, correct, and complete;
  • (b) charges incurred by you will be honored by the applicable financial institution;
  • (c) you will pay charges incurred by you in the amounts displayed or otherwise agreed upon, including applicable taxes; and
  • (d) you are authorized to use the relevant payment method.

If Root & Iron is unable to secure funds from your payment method because of insufficient funds, inaccurate information, an expired payment method, or another reason, Root & Iron may take reasonable collection action to the extent permitted by law.

Nothing in these Terms of Use limits your rights to dispute unauthorized, fraudulent, or incorrect charges as provided by applicable law.

Subscription and Membership Terms

If you purchase a recurring membership, subscription, program, or Service, the applicable offering may automatically renew at the end of each billing period unless you cancel before the end of the then-current billing period.

Specific billing terms, renewal periods, prices, and cancellation procedures will be disclosed at the time of purchase.

If you cancel a membership or subscription, access to applicable Services may continue through the end of the billing period for which you have already paid unless otherwise stated.

Root & Iron may change membership or subscription pricing from time to time. When required by applicable law, Root & Iron will provide advance notice of material price changes.

Price changes will generally take effect at the beginning of a subsequent billing period.

If you do not agree to a price change, you may cancel the applicable subscription or membership before the new price becomes effective.

If recurring payments are authorized, applicable charges and fees will be billed to the payment method designated by you.

You are responsible for maintaining current and accurate payment information.

Free Trials and Promotional Offers

Root & Iron may occasionally offer free trials, introductory pricing, discounts, or other promotions.

The duration and specific terms of any free trial or promotional period will be disclosed at signup or purchase.

Eligibility may be determined by Root & Iron in its reasonable discretion and may be limited to prevent misuse of promotional offers.

Unless otherwise disclosed, if a free trial converts into a paid recurring subscription, the applicable membership or subscription fee may be charged at the end of the free trial period unless you cancel before the trial expires.

5.Eligibility; Site Access, Security and Restrictions; Passwords

If account registration is available, you agree to provide complete, accurate, and truthful information when creating your Root & Iron Account (“Account”), including your name, mailing address, telephone number, email address, username, password, and other requested information.

Your login credentials are personal to you.

You are responsible for maintaining the confidentiality of your credentials and for activity occurring under your Account.

You agree not to allow unauthorized persons to use your Account and agree to notify Root & Iron promptly if you become aware of actual or suspected unauthorized use of your credentials or another security concern.

Root & Iron may suspend or revoke access to the Site when reasonably necessary for security, violation of these Terms of Use, unlawful activity, fraud, or other legitimate business reasons.

You are prohibited from violating or attempting to violate the security of the Site, including:

  • (a) accessing data that you are not authorized to access;
  • (b) logging into a server or Account that you are not authorized to access;
  • (c) attempting to probe, scan, or test the vulnerability of a system or network without authorization;
  • (d) attempting to breach security or authentication measures without authorization; or
  • (e) accessing or using any portion of the Site in violation of these Terms of Use or applicable law.

You may not use scrapers, crawlers, spiders, robots, automated scripts, or similar automated means to access or copy data from the Site, deep-link to restricted Site features, bypass technological restrictions, or circumvent measures designed to prevent unauthorized access, except where expressly authorized by Root & Iron or permitted by applicable law.

Violations of system or network security may result in civil or criminal liability.

Root & Iron may investigate suspected violations and may cooperate with law enforcement authorities when legally required or appropriate.

You agree not to use any device, software, or routine intended to interfere with the proper operation of the Site or Services.

6.Electronic Communications

When you use the Site or Services or send emails, messages, text messages, forms, or other communications to us, you are communicating with us electronically.

You consent to receive communications from us electronically to the extent permitted by law.

You agree that:

  • (a) agreements, acknowledgments, and consents may be signed electronically where permitted by law;
  • (b) standard message, data, and telecommunications rates charged by your carrier are your responsibility; and
  • (c) notices, disclosures, agreements, and other communications provided electronically may satisfy legal requirements that such communications be in writing.

Root & Iron may contact you by telephone, text message, mail, or email in connection with your Account, purchases, appointments, Services, administrative matters, or communications to which you have consented.

Marketing text messages and marketing emails will be sent only in accordance with applicable law and any consent requirements.

Root & Iron may request additional information reasonably necessary to verify your identity or protect against fraud or unauthorized Account access.

Failure to provide information reasonably necessary to verify an Account may result in temporary suspension or restriction of Account access.

7.Ownership of the Site and Related Materials; Additional Restrictions

All pages within the Site and materials made available through the Site are owned by or licensed to Root & Iron, Save My Knee, LLC, or their applicable licensors or suppliers.

The Site and its contents are protected by United States and international copyright, trademark, and other intellectual property laws.

Subject to these Terms of Use and payment of applicable fees, Root & Iron grants you a limited, revocable, nontransferable, personal, and nonexclusive license to access and use the Site for its intended purposes.

All rights not expressly granted to you are reserved by Root & Iron or its licensors, suppliers, publishers, rights holders, or content providers.

Neither the Site nor any part of the Site or Services may be reproduced, duplicated, copied, sold, resold, commercially exploited, or otherwise used for unauthorized commercial purposes without Root & Iron’s prior written consent.

You may not frame or use framing techniques to enclose any trademark, logo, image, text, page layout, or other proprietary information belonging to Root & Iron without written consent.

You may not use meta tags or hidden text utilizing Root & Iron’s name, trademarks, or branding without authorization.

Site content, including files, documents, programs, text, photographs, graphics, images, audio, videos, exercise demonstrations, educational materials, training programs, and downloadable resources may not be copied, distributed, modified, reproduced, published, transmitted, sold, or commercially exploited except as expressly authorized by Root & Iron in writing or permitted by applicable law.

8.No Users Under 18 Years Old

Unless otherwise expressly permitted in connection with a specific Service and accompanied by appropriate parental or legal guardian consent, the Site is intended for individuals who are at least 18 years old.

Individuals under 18 should not independently create Accounts, purchase Services, or provide Personal Data through the Site without authorization from a parent or legal guardian.

We do not knowingly collect Personal Data from children in violation of applicable law.

If you believe we may have collected Personal Data from a child contrary to applicable law, please contact us at robn9n@gmail.com.

9.Accuracy of Information; Functionality

Although Root & Iron attempts to maintain accurate and current information on the Site, Root & Iron makes no guarantee regarding the completeness, correctness, or accuracy of Site content, Service descriptions, educational information, pricing information, or other content.

The Site may contain typographical errors, inaccuracies, outdated information, or other errors.

If you become aware of an apparent error, please notify Root & Iron so that it may be reviewed and corrected where appropriate.

Information contained on the Site may be changed or updated without notice.

Root & Iron is not responsible for information or content posted or supplied by unaffiliated third parties.

Root & Iron retains discretion regarding operation of the Site and Services.

We may modify, suspend, withdraw, or discontinue functionality or features where reasonably appropriate.

We are not responsible for transmission errors, telecommunications interruptions, data corruption, internet outages, or other events outside our reasonable control.

Root & Iron may retain, delete, archive, or destroy communications and information in accordance with applicable law and our internal record retention policies.

10.Links to Other Sites

Root & Iron may provide links to websites owned or operated by third parties.

A link to a third-party website does not mean that Root & Iron controls, endorses, sponsors, or assumes responsibility for that website, its contents, its security practices, or its services.

Third-party sites are independent from Root & Iron.

You are responsible for taking appropriate precautions when accessing third-party websites, including protecting against viruses, malware, malicious software, or other potentially harmful content.

Your use of third-party websites is at your own risk and may be subject to separate terms and privacy policies.

11.User Information

If you submit, upload, post, or transmit health information, medical history, symptoms, personal information, consent forms, agreements, requests, comments, suggestions, files, videos, photographs, images, or other materials through the Site or Services (“User Information”), you agree not to provide User Information that:

  • (a) is knowingly false, unlawful, threatening, harassing, fraudulent, obscene, abusive, or defamatory;
  • (b) infringes another person’s privacy, copyright, trademark, trade secret, intellectual property, or other legal rights; or
  • (c) contains viruses, malware, malicious code, or another harmful component.

You represent and warrant that you possess all rights and authorizations necessary to provide User Information submitted to Root & Iron.

Health-related information submitted in connection with professional healthcare Services may be subject to separate privacy practices, consent forms, notices, and applicable federal or state healthcare privacy laws.

Where permitted by applicable law, Root & Iron may use information that has been appropriately de-identified so that it is no longer reasonably identifiable as relating to a specific individual for analytics, quality improvement, operations, research, or other lawful business purposes.

You agree not to:

  • (i) access the Site or Services unlawfully;
  • (ii) post or transmit information that is knowingly false, defamatory, obscene, fraudulent, unlawful, infringing, malicious, or harmful;
  • (iii) impersonate another person or misrepresent your identity or affiliation;
  • (iv) tamper with, hack, spoof, modify, corrupt, or interfere with the security or proper operation of the Site;
  • (v) use unauthorized robots, scripts, automated systems, or scraping tools;
  • (vi) reverse engineer, reverse assemble, reverse compile, decompile, disassemble, or otherwise attempt to extract proprietary source code except to the extent such restrictions are prohibited by applicable law;
  • (vii) alter the attribution or origin of electronic communications;
  • (viii) harvest or collect personal information about other Site users without authorization; or
  • (ix) infringe or facilitate infringement of copyrights, patents, trademarks, trade secrets, privacy rights, publicity rights, or other proprietary rights.

You agree to defend, indemnify, and hold harmless Root & Iron and Save My Knee, LLC from third-party claims, damages, liabilities, and reasonable expenses arising from User Information you unlawfully upload or transmit through the Site or from your material breach of this Section 11, to the extent permitted by applicable law.

12.Supplemental Terms Applicable to Healthcare Providers

These supplemental terms apply to licensed healthcare providers using the Site or Services in a professional capacity (“Provider”).

If there is a conflict between this Section and another provision of these Terms with respect to a Provider’s professional use of the Site, this Section shall control.

Where a Provider establishes a professional provider-patient relationship with a patient, that clinical relationship is directly between the applicable licensed Provider and patient.

Root & Iron and Save My Knee, LLC do not independently establish a physician-patient relationship solely by operating the Site.

Providers remain solely responsible for exercising their independent professional judgment, providing Services within the lawful scope of their professional licenses, maintaining required documentation, obtaining required consents, and complying with applicable professional and regulatory requirements.

Nothing contained in the Site or Services is intended to substitute for or override the independent professional judgment of a licensed healthcare Provider.

Providers are solely responsible for determining whether and how information obtained through the Site is appropriate for use in treating an individual patient.

13.Intellectual Property

Root & Iron and Save My Knee, LLC retain all right, title, and interest in and to the Site, Services, and any information, products, programs, documentation, software, graphics, videos, educational materials, exercise programs, training programs, branding, and other materials owned by Root & Iron or Save My Knee, LLC.

Third-party materials remain the property of their respective owners.

The information and materials available through the Site and Services may not be stored, copied, modified, reproduced, retransmitted, distributed, disseminated, rented, leased, sold, published, broadcast, publicly displayed, or circulated except as expressly authorized in writing or permitted by law.

Use, reproduction, copying, or redistribution of Root & Iron trademarks, service marks, logos, graphics, slogans, and brand materials is prohibited without prior written permission.

Nothing contained on the Site shall be interpreted as granting, by implication, estoppel, waiver, or otherwise, a license or right to use trademarks, service marks, copyrights, logos, or other intellectual property without express authorization from the applicable owner.

Root & Iron may remove content submitted by users that it reasonably believes is fraudulent, unlawful, abusive, defamatory, obscene, infringing, or otherwise violates these Terms of Use.

15.Disclaimer of Warranties

To the fullest extent permitted by applicable law, Root & Iron does not warrant that access to or use of the Site will be uninterrupted or error-free or that all defects will be corrected.

The Site, including general content and information contained within it, is provided “as is” and “as available,” with no representations or warranties of any kind except those that cannot lawfully be disclaimed.

To the fullest extent permitted by law, Root & Iron disclaims implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment, title, and non-infringement.

Root & Iron does not warrant the accuracy, completeness, reliability, or timeliness of general information obtained through the Site.

You assume responsibility for your use of general Site content, Site-related Services, and linked websites.

Root & Iron does not warrant that files available for download will always be free of viruses, worms, trojan horses, malware, or other harmful code.

You are responsible for implementing reasonable data backup and security procedures.

Services provided directly by a licensed healthcare professional may be subject to additional professional standards, consent forms, policies, or rights that cannot be waived under applicable law.

You acknowledge that participation in exercise, fitness, rehabilitation, performance training, and physical activity may involve inherent risks, including soreness, exacerbation of symptoms, falls, or physical injury.

Nothing in these Terms shall exclude or limit liability that cannot lawfully be excluded or limited.

16.Limitation of Liability Regarding Use of Site

To the fullest extent permitted by applicable law, Root & Iron, Save My Knee, LLC, and their affiliates shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to general use of the Site, Site content, Site-related Services, or linked websites.

This limitation includes, without limitation, lost profits, lost data, business interruption, or loss of use, whether the claim is based on warranty, contract, tort, or another legal theory.

Your primary remedy for dissatisfaction with general Site content is to discontinue use of the Site.

To the extent that a limitation of liability is permitted but a complete disclaimer is not, the maximum aggregate liability of Root & Iron and Save My Knee, LLC arising solely from your use of the general website shall not exceed five hundred dollars ($500).

Nothing in this Section limits any liability that cannot legally be waived or limited under applicable law, including any rights applicable to professional healthcare services.

17.No Third Party Rights

Unless expressly stated otherwise, nothing in these Terms of Use is intended to confer rights or remedies upon anyone other than you, Root & Iron, Save My Knee, LLC, their applicable affiliates, and expressly identified third-party beneficiaries.

Nothing contained in these Terms of Use is intended to discharge any legal obligation or liability independently owed by a third party.

18.Assignment

You may not assign, transfer, or delegate these Terms of Use or your rights under them without prior written consent from Root & Iron, except where applicable law provides otherwise.

Root & Iron and Save My Knee, LLC may transfer or assign these Terms of Use and their associated rights and obligations in connection with a merger, acquisition, corporate restructuring, sale of assets, or other lawful business transaction.

These Terms of Use shall bind and benefit the parties and their permitted successors and assigns.

19.Dispute Resolution; Arbitration Agreement

We encourage you to contact Root & Iron regarding any concern involving the Site or Services so that we may attempt to resolve the matter informally.

Except where prohibited by applicable law or otherwise stated below, you and Root & Iron agree that disputes, claims, or controversies arising from these Terms of Use or your use of the Site may be resolved through binding individual arbitration instead of a court proceeding.

Arbitration is generally conducted by a neutral arbitrator rather than a judge or jury and may involve different procedures and discovery rights than court litigation.

To the extent applicable, the Federal Arbitration Act shall govern the interpretation and enforcement of this arbitration provision.

By agreeing to arbitration, you and Root & Iron waive the right to a jury trial for claims subject to arbitration.

Nothing in this Section prevents either party from bringing an individual claim in small claims court when the claim qualifies for that court.

Notice of Dispute

Before initiating arbitration, the party seeking relief shall send written notice describing:

  • (a) the nature and basis of the claim or dispute; and
  • (b) the relief sought.

Notices to Root & Iron should be sent to:

Save My Knee, LLC d/b/a Root & Iron Rehab & Performance
Burtonsville, Maryland
Email: robn9n@gmail.com

If the parties do not resolve the dispute within 30 days after receipt of notice, either party may initiate arbitration where permitted by this Section.

Unless the parties agree otherwise, arbitration shall be administered by the American Arbitration Association (“AAA”) pursuant to the applicable AAA rules in effect at the time the arbitration is initiated.

Information regarding the AAA and its applicable rules is available through the American Arbitration Association.

Unless otherwise required by applicable law or agreed by the parties, arbitration hearings involving a United States resident may take place in Maryland or remotely as permitted by the applicable arbitration rules.

Payment of filing fees, administrative costs, arbitrator fees, and attorneys’ fees shall be determined by the applicable AAA rules and applicable law.

Individual Claims Only

To the fullest extent permitted by applicable law, you and Root & Iron agree that claims subject to arbitration may be brought only in an individual capacity and not as a plaintiff or member of a purported class, collective, consolidated, or representative proceeding.

Unless both parties agree otherwise, an arbitrator may not consolidate the claims of multiple individuals or preside over a class or representative proceeding.

This arbitration provision survives termination of these Terms of Use.

20.Force Majeure

Root & Iron shall not be deemed in breach of these Terms or liable for delay or failure to perform caused by events reasonably beyond its control, including acts of God, natural disasters, terrorism, war, invasion, public health emergencies, internet or telecommunications failures, electrical outages, earthquakes, floods, civil disorder, labor disputes, fires, governmental actions, or similar events.

21.Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Root & Iron, Save My Knee, LLC, and their applicable affiliates, owners, officers, employees, agents, contractors, and representatives from third-party claims, liabilities, damages, losses, costs, and reasonable attorneys’ fees arising directly from:

  • (i) your unlawful use or misuse of the Site or Services;
  • (ii) your material breach of these Terms of Use;
  • (iii) unlawful or infringing content you submit to Root & Iron; or
  • (iv) your intentional or negligent violation of another person’s intellectual property, privacy, or other legal rights.

This indemnification provision does not apply to the extent prohibited by applicable law or to liabilities caused by conduct for which Root & Iron cannot lawfully disclaim responsibility.

22.Application Support; Functionality

Questions and requests concerning Site support should be directed to Root & Iron.

To submit a support request, email: robn9n@gmail.com

Third-party technology providers, wireless carriers, device manufacturers, operating system developers, app stores, and marketplaces are generally not responsible for providing support for Root & Iron’s Site or Services unless separately stated by them.

Root & Iron will use commercially reasonable efforts to respond to support inquiries.

We may modify, replace, suspend, or remove Site functionality or features where reasonably appropriate.

23.Modified Devices and Operating Systems

Root & Iron is not responsible for errors, unreliable operation, security problems, incompatibility, or other issues resulting from use of the Site on rooted, jailbroken, modified, or unsupported devices or operating systems.

Use of the Site on a modified or unsupported device is at your own risk.

24.No Liability for Select Third Parties

Your wireless carrier, mobile device manufacturer or retailer, operating system developer, application store operator, marketplace provider, payment processor, and their respective affiliates, suppliers, and licensors may provide technology or services used in connection with the Site (“Select Third Parties”).

Except where expressly stated otherwise, Select Third Parties are not parties to these Terms of Use, do not own the Root & Iron Site, and are not responsible for maintaining or supporting the Site.

You are responsible for complying with any applicable terms imposed by Select Third Parties.

To the extent permitted by applicable law, Select Third Parties disclaim responsibility for Root & Iron’s operation of the Site and for claims arising solely from Root & Iron’s content, Services, or business practices.

Nothing in these Terms modifies any separate agreement between you and a Select Third Party.

25.Export Compliance

You agree to comply with applicable United States export control and sanctions laws concerning transmission of technical data, software, or regulated materials through the Site.

You represent that you will not knowingly use the Site in violation of applicable U.S. sanctions or export restrictions.

Root & Iron may restrict or terminate Site access when required to comply with applicable export, sanctions, anti-spam, cybersecurity, or similar laws.

26.Revisions; General

Root & Iron reserves the right to suspend or terminate access to all or part of the Site when permitted by law, including because of violation of these Terms of Use, unlawful conduct, fraud, security threats, or discontinuation of the applicable Service.

Root & Iron may modify these Terms of Use from time to time.

Updated Terms will become effective when posted or on another date expressly stated in the updated Terms.

Where applicable law requires additional notice or consent for a material change, Root & Iron will provide such notice or obtain such consent.

Your continued use of the Site following the effective date of updated Terms constitutes acceptance of those Terms to the extent permitted by applicable law.

If any provision of these Terms of Use is determined by a court or other tribunal of competent jurisdiction to be invalid or unenforceable, that provision shall be limited or modified to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms of Use, together with any applicable Privacy Policy, informed consent, payment agreement, cancellation policy, program agreement, or other expressly incorporated terms, constitute the applicable agreement between you and Root & Iron concerning the subject matter addressed herein.

For purposes of these Terms of Use:

  • (a) “include,” “includes,” and “including” mean “including without limitation”;
  • (b) “or” is not necessarily exclusive; and
  • (c) “herein,” “hereof,” “hereby,” “hereto,” and “hereunder” refer to these Terms of Use as a whole.

27.Products, Contents, and Specifications

All features, content, specifications, Services, products, and prices displayed or described on the Site are subject to change where permitted by law.

Weights, measurements, descriptions, images, colors, and similar representations may be approximate and are provided for convenience.

We make reasonable efforts to accurately display product attributes; however, device screens and settings may affect how colors and other characteristics appear.

The presence of a product or Service on the Site does not guarantee continued availability.

You are responsible for complying with applicable local, state, federal, and international laws concerning products purchased through the Site.

By placing an order, you represent that purchased products will be used lawfully.

Save My Knee, LLC d/b/a Root & Iron Rehab & Performance is not responsible for damage caused by misuse of products purchased through the Site.

28.Shipping Limitations

If physical products are sold through the Site, orders will be shipped to the address designated by the purchaser, subject to shipping restrictions and availability disclosed on the Site.

Applicable shipping terms, estimated delivery periods, risk of loss, returns, and other shipping policies may be provided at checkout or in a separate shipping or return policy.

You are responsible for providing an accurate and deliverable shipping address.

Claims involving lost or damaged shipments may be subject to the policies of the applicable carrier and any separate Root & Iron shipping or return policy.
